Ya know that creepy looking elf that you put on the shelf to keep watch over your kids during the holidays? Well, he just got popped for driving under the influence, even though at the time he wasn’t actually driving… he was actually sleeping. 

Yahoo! news is reporting that 23-year-old Brian Chellis, was found asleep in his van behind the wheel with an open container of something that wasn’t egg nog or holiday cheer. The report also says that Riverdale, New Jersey police found his van with the headlights on, engine running and music blaring.
